Moroccan Couple Jailed for WhatsApp Affair, Sparking Privacy Debate

The Court of First Instance of Temara sentenced a married woman and her alleged lover to 3 months and 2 months in prison respectively, for an extramarital love affair, despite the absence of flagrante delicto.
According to the daily Assabah, the Court based itself on messages and audios exchanged on WhatsApp between the two lovers, and recorded by the husband using a remote communication monitoring application.
The individual, who doubted his wife’s fidelity, managed to copy the compromising messages and photos onto CDs, attaching them to the complaint filed with the Public Prosecutor’s Office, to open a judicial investigation.
The husband’s request was accepted by the court, which had ordered the two suspects to be held in pre-trial detention pending the opening of the trial. According to the husband’s statements, his wife, who owns a commercial store, was having a love affair with a stranger.
