Tax Evasion Scheme Uncovered: Moroccan Companies Exploit Liquidation Loophole

The control and recovery agents, in coordination with the risk analysis and programming service, under the General Directorate of Taxes (DGI), are investigating suspicious activities related to the judicial liquidation of companies in an irregular situation with respect to the tax authorities.

"Specialized technicians" in the liquidation of companies with commercial courts, particularly in Casablanca, as well as experienced accountants in the artificial inflation of the debts of companies subject to judicial liquidation, are targeted by these ongoing investigations. After analyzing the notifications received from the liquidator in charge of the liquidation of several companies, the tax inspectors have identified suspicions of tax evasion by companies operating in the construction and public works, food distribution and sales, as well as textile and clothing sectors.

The companies concerned have accumulated tax debts related to corporate income tax, personal income tax and value-added tax. To deceive the vigilance of the tax control services, they have claimed poor financial health and bankruptcy. The experienced accountants hired by these companies have attested to their cessation of payments and their inability to repay their debts, particularly those related to current management and operating expenses. They have prepared the liquidation files based on concrete cases, based on the decisions and procedures taken by the reporting judges and the liquidators, thus aligning themselves with their assessment of the financial situation of the companies.

The inspectors have discovered that the accountants, in the preparation of the liquidation files, have set out to conceal the resources and expenses of these companies in order to present accounting records consistent with the nature of the companies’ activities and the market conditions in which they operate.
