Rym Fikri murder trial: defense challenges police procedures
The trial of the accused in the murder of Moroccan singer Rym Fikri’s husband continued this Tuesday. Before the Casablanca court of appeal, the prosecution and defense clashed sharply over the validity of police procedures.
During the hearing, the prosecutor general dismissed the procedural flaws raised by the lawyers. The magistrate justified the flagrancy of the offenses by the discovery of cannabis resin and forged documents in the vehicle of one of the accused. He also assured that the phone search was conducted with the explicit consent of the owner and that the absence of an interpreter was justified, as Reda Abakrim, alias "Turbo," understands Arabic orally.

The lawyers’ response was immediate. The latter criticized the prosecution for relying on recent legal texts rather than those in force at the time of the facts. The defense pointed out multiple procedural irregularities, notably denouncing the fact that the identity of the person summoned by the judicial police was not clearly established, in violation of article 66 of the criminal procedure code.

The criticisms then targeted the search conducted at the home of one of the accused. The defense team contested the legality of this operation, emphasizing that it took place in the absence of the property owner or a legal representative. Without prior judicial authorization, the lawyers believe that the qualification of flagrant offense, used to justify this police intervention, is unfounded.
