Spanish Man Faces 21-Year Sentence for 2018 Murder of Moroccan Immigrant in Almeria

A man is accused of having killed in 2018 in Almeria a Moroccan, then wrapped his body in plastic before abandoning it on a municipal embankment. The public prosecutor’s office is demanding 21 years in prison.

The defendant was helped by two accomplices for whom the prosecution has requested three years in prison. A jury will be constituted at the Almeria court to decide the fate of these three people accused of the murder of the Moroccan. In April 2019, a minor was prosecuted for this crime and sentenced to 18 months in prison with probation. He was accused of having helped to conceal the victim’s body, which was discovered by the Civil Guard.

In the indictment to which Europa Press had access, the victim went on October 13, 2018 at 4 a.m. to the house where JMOB, 18 years old, shot him with a hunting rifle, in the presence of ROB and JMFB, both 23 years old. The court must determine the circumstances of the Moroccan’s death, in particular try to find out if ROB tried to prevent the victim from leaving the property, allowing JMOB to shoot him in the back, without him being able to defend himself.

The main defendant then transported the victim’s body in a vehicle with the help of the minor, who has already admitted the facts, after tying him "with cables" and wrapping him "in plastic" before abandoning him on an embankment, four kilometers from the house. The defense of the defendant rejects these facts, arguing that the victim, a member of a criminal group dedicated to drug trafficking, would rather have gone to the house, accompanied by four other people, to steal drugs.

The victim would have pointed a weapon at ROB asking "where is the drug", which prompted his brother JMOB to use the hunting rifle. It was "self-defense", the defense said, pleading for acquittal. Investigators found traces of marijuana at the defendant’s, but no drugs. "The house was cleaned with bleach and ammonia," they said. The trial is scheduled for October 13.
