After his son’s fall into a sewer, he drags the city of Tangier to court
A family father has dragged the municipality of Tangier to court. The municipality is accused of negligence after the fall of a minor child into an open sewer on the public road.
The accident occurred on October 7, 2023. The child was walking alongside his mother when he fell into a sewer without its protective cover. The fall caused the young victim to lose consciousness and was rushed to the Mohammed V Hospital. Medical examinations revealed a skull fracture as well as injuries and bruises throughout the body. A medical certificate set a temporary incapacity of thirty days.
The victim’s father believes that the urban municipality bears full responsibility for this tragedy. He cites a serious breach of the obligation to maintain infrastructure and guarantee the safety of citizens. The complaint filed seeks civil compensation for the physical and moral damages suffered by the child. The plaintiff also requests that a medical expert assessment be carried out to assess the full extent of the damages suffered.
This legal action is based on decisions of the Court of Cassation and the Administrative Court of Appeal of Rabat. Moroccan case law does indeed recognize the responsibility of the administration for damages caused by a lack of maintenance of public facilities. The case is now in the hands of the justice system to determine the amount of compensation owed to the family.
