Al Omrane accused of having "swallowed" 700 m²: a citizen drags the State to court

It’s the earthenware pot against the iron pot. A resident of the Tangier region has decided to file a complaint against the company Al Omrane before the administrative court. He accuses the armed wing of the State in the field of housing of having amputated his land by nearly 700 m² to build a road, without any legal procedure or compensation.

The dispute is taking place in Douar Ghdir Defla, in the commune of Melloussa (prefecture of Fahs-Anjra). According to the plaintiff, the surprise was total: he discovered that Al Omrane’s equipment had started widening the road connecting the new city of Chrafate to the provincial network, directly encroaching on his property. In total, it is about 690 square meters that would have been "swallowed" by the asphalt without the owner being consulted.

What outrages the plaintiff is the total lack of respect for procedures. According to his statements, no notification was sent to him and no amicable agreement was sought. Even more seriously, he claims that the authorities have bypassed law no. 7.81 on expropriation for public utility. In plain terms: his land was taken by force, without an expropriation decree and, above all, without a single penny of compensation.

Faced with what he considers a serious attack on private property, the citizen has seized the administrative justice. He is demanding the appointment of an expert to officially assess the surface area that has been dispossessed and its market value. Pending the final verdict on the total amount of damages, he is requesting a provisional indemnity of 10,000 dirhams, reserving the right to quantify the final damage once the expertise has been carried out.
