Rabat Court Rules Wheel Clamps Illegal, Motorists Win Lawsuit Against Parking Company

The administrative court of Rabat heard four cases whose judgments were handed down last Monday. In these cases pitting SOMAGEC against motorists in Tangier, the victory went against the private company in charge of parking in Tangier.
According to Me Omar Benajiba, lawyer for the plaintiffs who is himself among the compensated, "These are the first four cases for which I have had a judgment, but my colleagues and I have many other similar files". The lawyer says he hopes that "in the coming weeks, many complaints will be filed with the court by people who have been victims of this installation of wheel clamps, deemed illegal".
According to the TelQuel newspaper, "the judgment was mainly based on the principle of freedom of movement, as well as on a report from the Court of Auditors published last August. The authors of the document deemed the collection of amounts paid by motorists, as fines, for the removal of the wheel clamp to be illegal".
It should be recalled that on March 5, the administrative court of Rabat had already ruled in favor of the cancellation of the administrative decision taken by the municipal council of Tangier in the part concerning the immobilization of vehicles through the use of wheel clamps on the wheels in order to prevent owners from moving in case of non-payment of the set rate.
