Investigations conducted by a private detective hired by Allianz played a pivotal role in the decision. The expert identified several irregularities, including the sudden interruption of GPS signals and the inability to identify the company receiving the goods. “What is strange is that, at the Traffic Directorate, these vehicles had not been deregistered, even though this is always done,” the investigation report noted.

The court stressed the contractual obligation to provide precise details about the location and circumstances of a theft in order to qualify for compensation. According to the ruling, the lack of material evidence and the complete absence of cooperation with Moroccan justice authorities made it impossible to verify the truth of the claim. The court therefore concluded that it was not possible to confirm the fraudulent seizure of the vehicles.
