Morocco: A real estate company is taking the Ministry of the Interior to court

The developer has filed a cross-appeal before the administrative court of Rabat. This complex procedure involves several institutional actors, including the Ministry of the Interior, the General Treasury, the General Directorate of Taxes, and the Legal Agent of Local Authorities.

At the origin of this dispute is a decision by a "controversial" municipal president, who had initially granted this tax privilege. The conflict has suddenly resurfaced when the same elected official ordered the tax collector to directly withdraw a substantial sum from the company’s bank account, in flagrant contradiction with the previously granted exemption.

Faced with this financial seizure, the real estate company denounces an approach devoid of any legal basis. Before the judges, its defense argues that the sudden revocation of this advantage, which it had been benefiting from for several years, raises serious administrative issues and requires legal justifications.

The administrative court of Casablanca having already ruled in the first instance in favor of the developer, the file is now in a new appeal phase.
