Moroccan Retiree Ordered to Repay Nearly €20,000 After Bank Card Was Used in Morocco

A Moroccan retiree disputed nearly €20,000 in benefits claimed by the Mutualité sociale agricole. He said he lived in France, while his bank card was regularly used in Morocco. Checks at his home led the court to uphold the debt.

The repayment covers €19,982.41 in solidarity allowance for the elderly (ASPA), paid from October 2019 to June 2021. To keep the benefit, the retiree had to meet a residency requirement in France. The Nîmes Court of Appeal ruled on January 8, 2026, that he did not meet it.

The man had been categorical during the inspection: he had not returned to Morocco since 2014 and always kept his only bank card with him. However, statements obtained from his bank showed repeated withdrawals in Morocco over several periods.

The inspector had also made several visits to his French address without managing to meet him. At the property, the gas meter showed no additional consumption, while the new electricity meter remained at zero.

The retiree said he had sent the card to his wife

Before the judges, the retiree explained that he sent his card to his wife, who lived in Morocco, and paid for his own expenses in cash in France. However, he provided no proof of these mailings. His account also contradicted what he had told the inspector.

His medical records did not help his case: the consultations he submitted did not correspond to the periods of absence in dispute.

The proceedings continued over a separate debt of €1,786.23 in housing assistance. In its ruling of August 13, 2026, the court declared itself not competent to rule on this issue, which had already been decided by the administrative court.

The €2,700 penalty imposed by the MSA was also upheld, bringing the amount owed for the ASPA and the penalty to €22,682.41.
