Her Trips to Morocco Betray Her: €23,323 in RSA Benefits to Repay

A recipient of RSA benefits disputed a €23,323 debt. However, her passports, bank accounts and reimbursed medical expenses revealed that she had spent approximately 22 of 33 months outside France, notably in the Nador region.

The Meurthe-et-Moselle Family Allowance Fund demanded precisely €23,323.72 from her in RSA benefits paid between March 2021 and January 2024. The Nancy Administrative Court has just upheld the entire debt, according to its judgment of July 24, 2026.

The recipient had been receiving RSA benefits since April 2019. During an investigation launched in January 2024, the CAF sought to reconstruct her periods of presence in France between November 2020 and October 2023.

The investigators notably relied on the stamps appearing in her passport and her husband’s. Several entries and exits had been recorded at Nador International Airport. Her bank statements, as well as medical care reimbursed by the French Health Insurance system, were also examined.

The checks revealed repeated absences, sometimes lasting five or six consecutive months. Between March 2021 and January 2024, the woman had therefore spent approximately 22 months outside France over a total period of 33 months.

Her son also lived in Melilla, around fifteen kilometers from Nador. The Spanish authorities indicated that the couple had lived in Spain until 2019, had not been removed from the Spanish tax registers and continued to maintain their tax residence there.

Silence about her stays rules out the two-year limitation period

To receive RSA benefits, a recipient must reside in France in a stable and effective manner. Stays abroad may not exceed a cumulative total of three months during the same calendar year. Beyond that, the benefit remains payable only for complete calendar months during which the person is actually present in France.

The recipient disputed the periods of absence identified by the CAF. She explained in particular that a stay in Morocco in 2022 was connected to the death of her mother-in-law. She also maintained that the center of her material and family interests had remained in France.

The court found that these assertions were not sufficiently substantiated to contradict the documents collected. The judges primarily noted that she had not declared her stays abroad, despite their duration and repeated nature.

This omission was considered deliberate. The recipient could therefore not invoke the two-year limitation period normally applicable to overpayments of RSA benefits. In cases of fraud or false declaration, the administration may in fact claim sums paid during the previous five years.

Another recipient had recently been required to repay €26,505 after continuing to declare her children as being schooled in France even though she lived with them in Morocco.

The Nancy Administrative Court ultimately rejected her appeal in its entirety. The RSA debt of €23,323.72 therefore remains entirely her responsibility.
