He spends 312 days in Morocco in one year: CAF demands €29,568 from him

The case was decided on April 8, 2026, by the Nanterre Judicial Court. According to the ruling published on Pappers Justice, CAF of Hauts-de-Seine had paid him the disabled adults’ allowance (AAH) between June 2020 and May 2023.

The organization began to have doubts after discovering that some of the beneficiary’s online declarations had been submitted from abroad. Its investigation then revealed that he had married in Morocco in 2019 and that his Moroccan wife and their two children lived in the kingdom. According to the Moroccan authorities, the man also resided and worked there.

Checks carried out with banks and airlines made it possible to reconstruct his absences from France: 179 days in 2020, 212 days in 2021, 312 days in 2022, and then 136 days between January and May 2023.

At the hearing, the beneficiary acknowledged regularly traveling to Morocco to see his family. However, he was unable to state how long he stayed there. He disputed having spent more than 92 days per year outside France, without providing any document capable of calling the investigation’s findings into question.

His stays far exceeded the permitted limit

To receive AAH, the beneficiary must reside permanently in France. Stays abroad may total up to three months per year. When this period is exceeded, the allowance remains payable only for complete calendar months spent in France, except in cases involving, in particular, studies or training.

The court considered that the periods recorded by CAF demonstrated that this residency requirement was no longer met. It therefore upheld the recovery of €29,567.97 in AAH paid between June 1, 2020, and May 31, 2023.

This case thus reached the opposite conclusion from that of another recent case in which the courts had sharply reduced the amount claimed by France Travail for stays in Morocco. In the present case, banking and airline data established particularly long absences.

The initial demand amounted to €39,171.97, as it also included an overpayment of personalized housing assistance. In this proceeding, the Judicial Court validated only the €29,567.97 corresponding to AAH. The APL debt was the subject of separate litigation before the Administrative Court.

The man explained that he was unable to repay such a sum. Nevertheless, he had found a permanent contract job in September 2025, with a gross monthly salary of €1,832.17, and requested a reduction or payment deadlines.

The court rejected these requests, considering that it could not itself grant a payment schedule or write off the debt in this proceeding. The beneficiary will have to negotiate the repayment terms directly with CAF. An additional €76.18 in service-of-process fees will be added to the €29,567.97.
