He Claimed to Be a Tenant in His Own Home: CAF Demands He Repay 8,681 Euros

A man born in Morocco will have to repay 8,681.41 euros to CAF. The court found that the overpayment was fraudulent after the discovery of several properties and statements deemed false.

The Versailles Court of Appeal upheld the ruling on February 5, 2026, according to the judgment published on Doctrine. The beneficiary received the disabled adults’ allowance, an increase for independent living, and housing assistance.

An inspection conducted between March 2018 and December 2019 led CAF of Pyrénées-Orientales to initially demand 10,705.41 euros from him. Of that amount, 8,681.41 euros corresponded to the AAH and the increase paid between December 2017 and September 2018.

Investigators discovered that he had declared himself to be a tenant of a home that he had actually owned since 2007. They also identified several other properties, including four homes rented out through an association he officially chaired.

He claimed that all his properties had been seized

When questioned by the inspector, the beneficiary denied still being an owner. He maintained that all his properties had been seized after his problems with the justice system and produced documents dated July 2015.

However, these documents concerned only one apartment. They did not prove the sale or seizure of the other properties, which he still co-owned jointly with his partner. CAF notably produced property records, property-tax notices, and an insurance contract identifying him as the owner.

A woman also stated that he had declared her, without her knowledge, as a tenant living alone in one of the homes in order to obtain an allowance. In reality, she was being housed there and lived with the beneficiary’s son. In the judges’ view, this statement confirmed that he still owned the apartment.

The court therefore found that he had concealed resources and confirmed that the overpayment was fraudulent. This classification allowed CAF to apply a five-year limitation period instead of two years. The declaration of assets is decisive, since concealed assets can lead to the repayment of several years of benefits.

The man remains ordered to repay 8,681.41 euros in respect of the AAH and the increase for independent living, as well as 500 euros in costs awarded to CAF at first instance. He will also have to bear the costs of the appeal.

The dispute concerning 2,024 euros in housing assistance was not decided on the merits by the court: it falls under the jurisdiction of the Montpellier administrative court. The beneficiary also claimed 3,000 euros from CAF for moral damages, but that claim was rejected.
