His Italian residence permit is not enough: CAF demands 2,160 euros from this Moroccan man
A Moroccan man challenged the repayment of 2,160.57 euros in activity bonus benefits demanded by the Isère CAF. His Italian residence permit failed to convince the French courts.
The Grenoble Administrative Court rejected his appeal in a judgment issued on June 23, 2026, available on Doctrine. The debt concerns activity bonus payments made from March to June 2021, then from October 2021 to June 2022.
The CAF considered that the beneficiary had neither a right of residence nor a permit authorizing him to reside legally in France at the time. Its amicable appeals commission had confirmed, on April 8, 2024, the overpayment of 2,160.57 euros.

The Moroccan man nevertheless maintained that, since November 2010, he had held a residence permit issued by Italy and authorizing him to work. He therefore considered that the amounts received as activity bonus benefits should not be reclaimed.
An Italian permit valid only in Italy
The court recalled that foreign nationals who are not citizens of the European Union must hold a permit authorizing them to reside legally in France in order to receive the benefits concerned. However, the document presented by the applicant had been issued by the Italian authorities.
In the judge’s view, this permit authorized him to stay in Italy but could not be treated as a French residence permit under the Social Security Code. Its possession was therefore insufficient to establish that he had been residing legally in France during the periods examined by the CAF.
Another factor weighed in the decision: the Moroccan man was subject to an order to leave French territory, accompanied by a period for voluntary departure, which had been notified to him on July 21, 2022.

The court ultimately rejected all of his claims. The CAF’s decision therefore remains valid, and the overpayment of 2,160.57 euros must be repaid.
