Moroccan Man Donates Properties to Brother Before Divorce, Family Sues for Inheritance

A man donated his five real estate properties to his brother, a few days before requesting a divorce. Deprived of a legitimate inheritance, his wife and children brought the case before the Casablanca court.
According to the site Akhbarona, the woman and her children demand the cancellation of the transfer contracts in favor of the brother, as well as a lump sum compensation of 10,000 dirhams with immediate execution.
According to the complaint, "the conclusion of transfer agreements, by the defendant in favor of his brother, a few months before the divorce proceedings, supposed to oblige him to pay provisional and permanent damages, in accordance with the family code, is an attack on the principle of public security".
"This guarantee is granted by the legislator to all creditors linked by contracts or having links allowing them to benefit from compensation within a legal framework," it is further read.
