Moroccan Doctor Demands $800,000 from Deceased Patient’s Family for One Night Stay

A doctor demands that the family of a deceased patient pay him 8 million dirhams for just one night spent in a clinic in El Jadida. The doctor claims that the deceased had issued him a check for this amount.
According to the facts, the signatory of the check had been admitted to a clinic following a malaise, reports Assabah. He had been required to issue a guarantee check to the clinic management before being taken care of. The patient had not objected to it. However, he had died the night of his hospitalization.
To their great surprise, the members of the deceased’s family received a visit from a bailiff who asked to meet the signatory of the check. In response, they told him that he was already deceased. Having discovered that the plaintiff is the doctor of the clinic, the wife of the deceased filed a complaint for fraud and breach of trust. She explained that her husband had issued a blank check to the clinic management as a guarantee and that he had planned to pay in cash after his discharge from the hospital.
Unexpectedly, the conservatory seizure of the deceased’s property was carried out a few days later to guarantee the payment of the sum of 8 million dirhams. The deceased’s wife stated that the check had been filled out by a person - whose identity she does not know - other than her husband. The Court of Appeal of El Jadida lifts the seizure of the property but the president of the court of first instance restores it. Faced with the situation, the family turned to the Higher Council of the Judiciary.
