Moroccan Clinic Ordered to Pay $100,000 for Medical Error Causing Child’s Disability

The Court of First Instance in Casablanca has ordered a private clinic to pay 1 million dirhams to the parents of a severely disabled child following a medical error.
The medical expertise, ordered by the investigating judge, revealed a link between the medical fault and the damage suffered by the child. The loss of autonomy was considered total, and the disability will have negative repercussions on the child’s physical and psychological health.
The facts date back to March 2016, explains the website Al Oumk. Following pains, the child was transferred to a pediatric clinic in the city, where examinations were carried out. The attending physician administered medication, believing it was not a medical emergency.
According to a second medical opinion, obtained a few days later at the Casablanca University Hospital, the child was suffering from orchitis (inflammation of the testicle), which had not been treated in time. Surgical intervention was necessary and the atrophied testicle had to be removed.
In its defense, the clinic tried to disengage, attributing full responsibility to the pediatrician who had made the diagnosis. But the request was not accepted by the court, which considered that, despite the absence of a contractual relationship between the doctor and the clinic, the consultation had taken place within the establishment.
