The prefecture ignores her request: this Moroccan woman obtains 48 hours, 1,500 euros and 150 euros per day

Born on 24 July 1997 in Marrakech, the young Moroccan woman entered France legally in 2022. Since 4 April 2025, she had held a residence permit bearing the designation “employee,” valid until 3 April 2026.

On 2 April 2026, the day before her permit expired, she submitted a renewal application on the Hauts-de-Seine prefecture’s “Simplified procedures” platform. However, she was not offered an appointment to formally register her application and obtain the temporary receipt allowing her to continue proving her right to reside and work.

The Moroccan woman did not wait any longer. As early as 30 April, she urgently petitioned the Cergy-Pontoise administrative court to compel the prefecture to receive her. She requested an appointment and a receipt authorizing her to work within 48 hours, subject to a penalty of 150 euros for each day of delay.

The prefect of Hauts-de-Seine, to whom the application was communicated, submitted no observations in its defense. In his order of 13 August 2026, the judge recalled the significant consequences that the absence of a temporary receipt may have on a foreign national’s right to remain in France and, depending on the circumstances, to work.

The court considers that the administration must receive a foreign national who has requested a renewal, register the application when the file is complete, and provide the provisional document required by the regulations. This process must be completed within a reasonable period.

The prefecture placed under a penalty

In the Moroccan woman’s case, the court found that the condition of urgency was met. The measure requested was also deemed useful and did not obstruct any existing administrative decision.

The judge therefore ordered the prefect of Hauts-de-Seine to schedule an appointment for her so that she could register her renewal application. Provided that her file was complete, she was also to receive a renewal receipt within 48 hours of notification of the order.

This obligation was accompanied by a penalty of 150 euros for each day of delay. This sum does not constitute compensation immediately acquired by the Moroccan woman: it is intended to pressure the prefecture to implement the decision quickly. Any enforcement of the penalty would depend on the delay actually established.

The state was also ordered to pay the young woman 1,500 euros directly for the costs incurred in the proceedings. On this point, her request was fully granted.

The court did not, however, renew her residence permit itself. It required the prefecture to allow her to register her application and provide her with a receipt if the file was complete. This provisional protection is decisive: without a valid document, another Moroccan woman had already found herself stuck between the online procedure and the prefecture counter, while a Moroccan man had waited nearly three years before finally obtaining an administrative appointment.

For this Moroccan employee, the prefecture’s silence therefore ultimately cost the state 1,500 euros. Any further delay may now trigger a penalty of 150 euros per day.
