His receipt expires, Moroccan man loses his salary despite having a permanent contract worth 3700 euros

Born in 1998, the Moroccan man arrived in France in 2015 to study architecture. On 14 March 2023, he obtained the state diploma in architecture, at Master’s level.

After several professional experiences, he was hired on 3 March 2025 as an interior architect by AMP-Paris, which belongs to the Humbert & Poyet group. His fixed-term contract, concluded with a work permit, provides him with a gross monthly salary of 3700 euros.

His “temporary worker” residence permit expired on 14 January 2026. Five days later, he applied for its renewal as well as a change of status to a “private and family life” permit. The prefecture issued him a receipt valid until 18 July.

Then nothing more. Despite several follow-ups, his renewal application remained unanswered.

His employer suspends his contract

On 20 July, two days after the receipt expired, his employer suspended his contract. Without a document enabling him to prove his right to stay and work, the Moroccan man could no longer carry out his job and found himself deprived of his salary.

The stakes are all the higher because a permanent contract had already been signed for him to take up his position on 3 September 2026. A work permit for this new job had even been granted on 1 July.

The Moroccan man has also been in a civil solidarity pact since February 2025 with a French woman, with whom he has been living as a couple since the beginning of 2023.

He then brought the matter before the Paris administrative court. The prefecture argued that an appointment had finally been set for 29 July to renew his receipt, but the judge considered that this did not eliminate the implicit decision resulting from the administration’s silence.

In its order of 31 July 2026, the court notably found that the situation prevented the Moroccan man from working and deprived him of income. His professional career, the permanent contract already signed and his life with his French partner also gave rise to serious doubt as to the legality of the refusal.

The implicit decision was suspended. The prefecture must review his case within one month and issue him, within ten days, with a temporary residence permit authorizing him to work.

The State must also pay him 1000 euros. However, the judge did not grant the €100-per-day penalty requested by the Moroccan man.
