The Prefecture Ignores a Ruling, So This Moroccan Man Returns to Court and Wins Again

Born in 1987, the Moroccan national arrived in France at the age of one. He lives with a French woman and is the father of two French children born in 2017 and 2018.

In October 2024, he applied to renew his residence permit. The Bouches-du-Rhône prefecture refused several times and notably issued him an OQTF.

On 18 December 2025, the Marseille administrative court ultimately ruled in his favor: the decisions were annulled and the prefect was ordered to issue him, within one month, a two-year “private and family life” residence permit. No appeal was filed.

But the deadline passed and the Moroccan man still did not receive his documents. At the beginning of January 2026, the prefecture requested additional documents from him, which he promptly submitted. Nevertheless, his temporary residence authorization expired on 27 January without being renewed.

His employment contract and salary are suspended

The consequence was immediate: deprived of a document authorizing him to work, he saw his employer suspend his contract and salary. With no other income, he could no longer contribute normally to household expenses or to the care of his two children.

He therefore returned to court. His urgent application was initially rejected by the administrative court, which considered that the prefecture had taken sufficient steps. The Moroccan man then brought the case before the Council of State.

In its ruling of 19 February 2026, France’s highest administrative court reached the opposite conclusion. It found a “persistent failure” by the administration to enforce the judgment, which had become final.

For the judges, simply requesting additional documents was not sufficient. The situation also constituted a serious and manifestly unlawful infringement of the Moroccan man’s rights, particularly his right to work.

The Council of State therefore imposed very short deadlines on the prefecture: a temporary residence authorization allowing him to work had to be issued within 48 hours, followed by his two-year “private and family life” residence permit within one month.

The state will also have to pay him 2,000 euros for his legal costs.

After already having the refusals of residence and the OQTF annulled, the Moroccan man therefore had to return to court simply to force the prefecture to enforce a decision that it had not even challenged.
