French Court Rejects Urgent Bid to Halt CAF’s €9,159 Debt Collection

A self-employed worker operating in Morocco asked for collection of a €9,159.75 debt claimed by the CAF of Val-d’Oise to be suspended. On August 20, 2026, the Cergy-Pontoise administrative court rejected his urgent appeal for lack of a legal argument.

French Court Rejects Urgent Bid to Halt CAF’s €9,159 Debt Collection

The man feared that seizure of his assets would prevent him from meeting his family’s basic needs. Before the judge, he cited the heavy expenses he had to cover in Morocco. He also said he had asked for a payment plan from the bailiff’s office appointed by the CAF, but the request had been refused.

His challenge concerned, in particular, the repayment of benefits paid in June and July 2022. He said the agency was wrong to demand repayment of the full amount, since he had left France the following August 23.

To stop the proceedings, he applied to the urgent applications judge. This procedure makes it possible to temporarily suspend the enforcement of an administrative decision that is being challenged in an action for annulment or amendment. Two conditions must be met: urgency warranting the judge’s intervention and an argument likely to raise serious doubt about the legality of the contested decision.

A departure date, but no legal argument

The application failed on the legal arguments. In his ruling published on Pappers Justice, the judge noted that the benefit recipient merely stated the date he left France and “raised no legal argument.”

The judge applied Article L. 522-3 of the Code of Administrative Justice. This provision, available on Légifrance, allows an application to be dismissed by a reasoned order, without a hearing, when it appears, in particular, to be manifestly unfounded. The case was decided under this procedure.

The benefit recipient sought two measures: suspension of the enforcement order issued by the CAF on March 3, 2026, and a halt to the compulsory collection proceedings initiated by the bailiffs. The dismissal covered the entire request for suspension.

His application was registered on May 12, 2026, and supplemented with a written submission on June 12.
