The prefecture blocks her residence permit for eleven months: this Moroccan woman makes it pay €1,100

The Moroccan national held a multi-year residence permit bearing the designation “private and family life,” valid from January 27, 2024, to January 26, 2026. She had requested its renewal as early as September 29, 2025, nearly four months before it expired.

The administration had only issued her a provisional residence document valid until March 10, 2026. No explicit decision was subsequently made. The silence of the Bouches-du-Rhône prefecture therefore resulted in an implicit refusal.

On July 30, the Moroccan woman urgently brought the matter before the Marseille Administrative Court. She requested a new multi-year permit and, pending its issuance, a provisional authorization allowing her to continue working.

The prefecture submitted no brief to defend its decision. At the hearing on August 13, it was also “neither present nor represented,” the order of the Marseille Administrative Court specifies.

A work authorization within five days

The judge points out that urgency is, in principle, recognized when a person challenges the refusal to renew a residence permit they already held. In the absence of any defense from the prefecture, there is nothing to overturn this presumption.

The court also finds serious doubt as to the legality of the refusal, particularly in view of the rules governing the renewal of multi-year residence permits and the right to respect for private and family life. The enforcement of the implicit decision is therefore suspended.

The prefect of Bouches-du-Rhône must now provisionally issue the Moroccan woman with a multi-year “private and family life” permit within one month. Above all, it must provide her within five days with a provisional residence authorization allowing her to work.

These obligations are subject to a penalty of €50 per day of delay. As in other cases involving residence permits blocked by prefectures, this amount will not be automatically paid to the Moroccan woman: it may be claimed if the administration delays implementing the decision.

The State must, however, pay her €1,100 for her legal costs. This interim order does not yet definitively settle the case: it suspends the refusal and provisionally protects the Moroccan woman until the judgment on the merits is issued.
