Spanish Court Dismisses Genocide Complaint Against Polisario Front Leader

The Spanish justice system decided on Thursday to dismiss the complaint for "genocide" targeting Brahim Ghali, the leader of the Polisario Front separatists, who was summoned by a judge in early June while he was hospitalized. The complaint had been filed by the Sahrawi Association for the Defense of Human Rights (ASADEDH) for alleged genocide offenses related to acts allegedly committed against Moroccan citizens between 1975 and 1990.

It is the judge in charge of the case who announced that the complaint for "genocide" against the Polisario Front leader was dismissed. In a statement, the High Court of the National Court indicated that "the facts are time-barred, the commission of the crime of genocide is not established, and the testimonies of the witnesses contradict the allegations contained in the complaint" which had been filed in 2008.

Brahim Ghali was the subject of two complaints in Spain. One filed by the ASADEDH based in Spain, and a second, still ongoing, by Fadel Breika, a dissident from the Polisario Front who has been naturalized Spanish.

The reception and hospitalization of Brahim Ghali in Spain had triggered a rather serious diplomatic crisis between [Morocco] and Spain. A crisis that reached its peak with the arrival in mid-May of more than 10,000 migrants in the enclave of Ceuta following a lack of controls at the border between Morocco and the enclave.
