Morocco ONCF Train Delay: Traveler Wins 5000 Dirhams Compensation
The commercial court of Casablanca ordered ONCF to pay 5,000 dirhams to a trainee lawyer. He missed a crucial professional appointment due to a ninety-minute train delay.
The incident occurred on November 23, 2024. That day, the plaintiff left Casa-Port station with the objective of arriving in Témara at 11 a.m., in order to participate in a judicial expertise scheduled thirty minutes later. Stuck mid-journey, the train only reached its final destination at 12:30 p.m. This delay prevented the young legal professional from honoring his appointment, exposing him to a breach of duty toward his internship supervisor.

Although he initially demanded 30,000 dirhams in compensation for the damages, the judges ultimately awarded him 5,000 dirhams, while ordering the public company to cover court costs. Payment of this amount will be handled by Wafa Assurance.

To justify this ruling, the court dismissed the railway operator’s defense argument. According to the verdict, the company’s general conditions cover cancellations announced before departure, but in no way cover unexpected stops on the tracks. The judges emphasized that a carrier’s mission involves a strict obligation to meet its clients’ schedules.
Based on Article 480 of the Commercial Code, the court concluded that a "sudden and prolonged" stoppage constitutes proven harm, justifying financial compensation for the disruption to the passenger’s journey.
