To justify this ruling, the court dismissed the railway operator’s defense argument. According to the verdict, the company’s general conditions cover cancellations announced before departure, but in no way cover unexpected stops on the tracks. The judges emphasized that a carrier’s mission involves a strict obligation to meet its clients’ schedules.

Based on Article 480 of the Commercial Code, the court concluded that a "sudden and prolonged" stoppage constitutes proven harm, justifying financial compensation for the disruption to the passenger’s journey.
