Morocco lawyer wins 330000 dirhams from State over mother’s death

The case begins with a family tragedy. In 2023, a woman died during childbirth in a public hospital. Her family was told at the time that the death was natural and linked to internal bleeding.

The deceased left behind her husband, nine children, including the newborn, as well as her parents. But less than a year later, one of her sons took the oath and joined the Marrakech bar. Having become a lawyer, he wanted to understand the exact circumstances of his mother’s death.

After several steps, he was able to access part of the medical file. According to elements reported by lawyer Yassine Essabbar, these documents revealed troubling points in the care provided, notably a lack of certain medicines and equipment in the intensive care unit.

Justice finds faults

An action was then brought before the administrative court of Marrakech against the Ministry of Health and Social Protection and the Moroccan State. The family requested that the administration’s responsibility be recognized for service faults related to the death.

The court ordered a judicial medical expertise. This concluded that service faults existed and contributed, indirectly, to the mother’s death.

On this basis, the administrative court issued a first instance judgment condemning the State to pay 330,000 dirhams in compensation to the heirs of the deceased.

The judgment is not final, however. It can still be appealed. For Yassine Essabbar, this case above all shows the importance of turning to the courts when serious elements allow one to demand accountability and obtain redress.
