Morocco to Ease Marriage Rules for Citizens Living Abroad

The Moroccan Family Code is about to undergo substantial changes. The Minister of Habous and Islamic Affairs, Ahmed Toufiq, presented last night before King Mohammed VI seven amendments approved by the Supreme Council of Ulema, some of which concern Moroccans residing abroad.
Among the points discussed is the possibility for Moroccans residing abroad (MREs) to contract a marriage without the presence of two Muslim witnesses. This measure has been requested for many years by MREs, and it was not uncommon, when in the consulate, to be solicited by MRE couples in search of witnesses to validate their marriage.
Another advancement is the delegation of legal guardianship to the mother with custody of the children. Until now, the father retained control in this area. From now on, the mother will be able to carry out the legal acts necessary for the well-being of her children without having to systematically consult her ex-spouse, a change that removes some barriers.
