Morocco’s Domestic Worker Law Sees Low Compliance, Only 1,877 Contracts Registered
Two years after the entry into force of Law 19-12, relating to the employment contract, very few employers of domestic staff comply with the provisions of this legislation despite awareness campaigns. As of mid-July last year, only 1,877 domestic employee contracts had been filed with the Labor Directorate.
The latest statistics from the Labor Directorate, under the Ministry of Employment and Professional Integration, revealed that in addition to the 1,877 employment contracts filed nationwide by mid-July 2020, 150 foreign contracts were registered during the same period, according to the newspaper Aujourd’hui le Maroc.
The Marrakech-Safi region is in 1st place with 757 files. It is followed by Rabat-Salé-Kénitra (416), Casablanca-Settat (313) and Souss-Massa (172) contracts. Tanger-Tétouan-Al Hoceima (98) and Fès-Meknès (65) occupy 5th and 6th place respectively. The remaining 56 contracts are distributed among the regions of the Oriental (27), Daraa-Tafilalet (13), Guelmim-Oued Noun (10), and Béni-Mellal-Khénifra (6).
According to the same statistics, the 1,329 employers who have voluntarily joined the National Social Security Fund (CNSS) have only declared 1,632 domestic workers. Thanks to this membership, domestic staff can benefit from all social security benefits, including AMO, unemployment benefits, maternity leave, daily sickness benefits, maternity leave, family allowances... In addition, legal proceedings could be taken against any worker who does not comply with the provisions of Law 19-12.
