Moroccan Court Investigates Five Municipalities for Alleged Financial Misconduct

The Court of Cassation has been seized by the Attorney General at the Court of Auditors against five municipalities in cases relating to "facts that appear to justify criminal sanctions".
The first case concerns the accounts of the municipality of Bougargouh (Settat) for the year 2015. It reveals the presentation, by a competing company, of two certificates that may contain erroneous data as part of a public tender.
Regarding the second municipality, that of Fkih Ben Salah, the Court of Auditors detected the conclusion and execution of public contracts relating to urban development, without respect for the legal provisions in force.
For its part, the municipality of Harhoura is guilty of non-compliance with the regulatory provisions relating to local taxation, as well as the violation of the legal and regulatory provisions governing urban planning and the creation of subdivisions.
As for the fourth case, it concerns the municipality of Guelmim and reveals erroneous data contained in documents relating to certain contracts and orders, presented by competing companies, as well as the registration of one of these companies in the commercial register.
As for the case of the municipality of M’ririt, it reveals the conclusion and execution of several public contracts and purchase orders, in violation of the legal and regulatory provisions in force.
At the end of the study of the files and the incriminated facts, the Court of Auditors called on the Attorney General of the King at the Court of Cassation to take the measures it deems appropriate, in accordance with Articles 111 and 162 of Law No. 62-99 establishing the Financial Jurisdictions Code.
