Moroccan Court Clarifies: No Marital Rape Conviction in Tangier Domestic Violence Case

While many associations and generally Moroccans had applauded the decision of the Tangier court to sentence the perpetrator of a rape on his wife to two years in prison last December, the said court now denies this information.

The conviction that the Tangier court has pronounced concerns only the violence of which the wife was a victim. As for the sexual relations that allegedly caused her abnormal vaginal bleeding (for which, among other things, she was hospitalized), they fall, according to the court, within the framework of (normal?) marital relations.

The court did indeed convict the husband for "intentional harm" after the complaint filed by his wife in October, but no conviction for marital rape.

The case dates back to June 2018, in Larache. The wife had requested a divorce, a request that was very badly received by her husband (despite the constant disputes and the couple’s problems). To take revenge, the man physically and sexually abused his wife.

The husband is said to have claimed that his actions were only due to mood swings caused by financial difficulties and his wife’s refusal to stay in the family. She wanted to leave the house.

In any case, for the court, only the serious violence justified the conviction. The sexual relations that required hospitalization are not punishable.
