Moroccan Court Acquits Entrepreneurs in ANAPEC Fraud Case

The criminal chamber of the Fès Court of Appeal annulled the judgment rendered at first instance against a couple of entrepreneurs, accused of misappropriation of public funds, forgery and use of forgery. The spouses had benefited from funding from the National Agency for the Promotion of Employment and Skills ANAPEC.
The judgment, handed down by the investigating judge in the presence of ANAPEC, which had constituted itself as a civil party, put an end to a 9-month trial, reports Assabah. Declaring the civil action of the ANAPEC inadmissible, the judge acquitted the two defendants of the charges of misappropriation of public funds and falsification of administrative documents.
Convicted at first instance to 1 year in prison and a fine of 10,000 dirhams each, the two spouses had been found guilty of abuse of corporate assets. They would have diverted, for personal purposes, 360,000 dirhams intended to finance a public utility project.
Contesting the decision of the first instance judge, the defense of the national agency and the public prosecutor’s office had brought the case before the court of appeal, the same source continues, without specifying whether the ANAPEC plans to appeal to the Supreme Court.
