Moroccan Convicted of Murder in Spain Seeks Extradition After 18-Year Sentence

The Provincial Court of Cadiz in Ceuta has sentenced the Moroccan Mohamed A. to 18 years and three months in prison for sexually assaulting and killing Laura Gutiérrez, a young nursing student. His lawyer is requesting his extradition to Morocco.
The defendant, Mohamed A. known as Tony, stated at the trial that "he continues to regret" his act of December 6, 2011, the date on which he took the life of his victim, who had come to Ceuta to take a professional exam. He "continues to ask for forgiveness." Sentenced to a term of 18 years and 3 months in prison at first instance, reduced to 14 and a half years by the Supreme Court, he wishes to be expelled to Morocco, under the application of Article 89 of the Penal Code.
The convicted person is not requesting extradition to serve the remainder of his sentence in Morocco, but rather requests a return to the country, free of movement. The prosecutor’s office does not approve of this defense proposal, and the civil party does not consider it appropriate to grant this advantage to the accused without a minimum of requirements, recalling that the latter had not even paid the compensation to which he had been sentenced. Mohamed A. has sworn that, for the past few months that he has been working in prison, he is doing his best to honor this debt.
The court, which will look into the matter this Wednesday, will have to deliver its decision in the coming days.
