French Court Overturns Moroccan Man’s Residency Refusal After Prefecture Ignores His Requests
A Moroccan man who has lived in France since 2013 applied to regularize his status in late 2023. The Nord prefecture did not respond to his application or his request for an explanation. The Lille Administrative Court overturned the refusal and ordered the state to pay €1,000.
Born in 1991 in Khouribga, the Moroccan national arrived in France on September 9, 2013, on a long-stay student visa. His student residence permit was then renewed until October 2017, according to the ruling issued on September 23, 2026, by the Lille Administrative Court.
On November 1, 2023, he applied for exceptional admission to stay. The Nord prefecture received his application five days later. No letter was sent to him: after four months of silence, an implied refusal automatically took effect.
The Moroccan man then sought an explanation. On December 18, 2024, he formally asked the prefecture to provide the reasons for the refusal. The administration had one month to respond. It remained silent again.
The prefecture also fails to respond before the court
Before the Lille Administrative Court, the prefecture filed no defense brief. The judges found that the application had indeed been received and that there was nothing to suggest it was incomplete. The prefect had also not disputed that the application could be submitted by mail.
An implied refusal of a residence permit does not have to be accompanied by reasons immediately. But once a foreign national formally asks to know the reasons, the administration must provide them within one month. The Nord prefecture failed to meet this obligation.
This single procedural irregularity is enough to overturn the refusal. The court therefore did not need to examine the Moroccan man’s other arguments, which included his personal circumstances and his right to respect for his private and family life.

The prefecture must now review his application and issue a new decision within three months. The court does not grant the requested residence permit itself, but requires the administration to rule again. The state must also pay the Moroccan man €1,000 toward his legal costs.
