MREs who live in Morocco but rent out real estate in France are not necessarily outside the scope of French tax authorities. Rental income from a property located in France must be declared, even when the owner resides abroad.

Living in Morocco, Belgium, Spain or elsewhere is not enough to eliminate tax obligations related to real estate located in France. For MREs who own an apartment, house or commercial space rented out in France, rental income remains income from a French source.

The rule is important for Moroccans who have left France while retaining real estate. Some believe that once settled in Morocco, their rental income no longer falls under French tax administration. In reality, when a property located in France generates rental income, this revenue can remain taxable in France, even if the owner no longer lives there.

French tax authorities notably distinguish between unfurnished and furnished rentals. In the first case, rental income generally falls under real estate income. In the second, it is generally treated as industrial and commercial profits. The procedures and forms can therefore vary depending on the type of rental.

For MREs concerned, the question is not only about where they live, but where the property that generates the income is located. An apartment rented in Paris, Marseille, Lyon or Lille remains a property located in France. Rental income collected on this property must therefore be taken into account in the French tax obligations of the non-resident owner.

Moving to Morocco does not make rental income disappear

The situation can affect several profiles: a former Moroccan employee who returned home after retirement, a family settled in Morocco but owning property in France, or an MRE who keeps an apartment for rent after leaving French territory. In all these cases, rental income received must not be ignored.

The owner must declare this income under the conditions set by the tax authorities. Depending on the nature of the rental and the applicable regime, it may fall under a simplified regime or the actual regime, with the possibility of declaring certain expenses. But the very existence of rental income must be reported.

The tax treaty between France and the country of residence can also play a role in avoiding double taxation. But it does not mean that French rental income automatically escapes France. It mainly serves to allocate taxation rights and organize tax treatment between the two countries.

For MREs, the risk often comes from a misinterpretation. The fact of no longer living in France does not mean that the French tax administration no longer has any oversight of income derived from property located on its territory. In case of omission, the owner may face tax assessments, interest or penalties.

Before renting out property in France while living in Morocco, it is therefore preferable to verify the applicable regime, keep documents related to the property and properly declare rental income received.
