ONEM reminds that a fully compensated unemployed person must have their main residence in Belgium and reside there effectively. This condition is at the heart of the right to benefits. It means that a beneficiary cannot settle permanently in Morocco while continuing to receive Belgian unemployment normally.
Stays in Morocco remain possible, but they are regulated. An unemployed person is entitled to 24 days of vacation per year, or four weeks. These days include Saturdays. They can be used to travel abroad, particularly to Morocco, but they must be properly declared.
The rule therefore concerns vacations, family visits, weddings, summer stays or personal trips. A beneficiary cannot transform these authorized weeks into an undeclared long stay, especially if they continue to receive their benefits as if they were available in Belgium.
Four weeks, not a prolonged stay
The problem often arises during summer. A Moroccan unemployed person may want to spend two or three months in Morocco with their family. But from ONEM’s perspective, a prolonged stay abroad is not compatible with unemployment obligations, except with special exemption.
The unemployed person must remain available for the Belgian job market. They must be able to respond to summons, actively seek work and comply with obligations imposed by regional employment services. A long stay in Morocco can make this availability impossible.
Exceptions exist. ONEM provides that an unemployed person can reside temporarily abroad if they benefit from an express exemption from the obligation to reside in Belgium. This may notably concern job search abroad or training. But this exemption must be requested and granted according to the rules provided.
It is therefore not enough to warn orally or consider that a family trip is normal. The unemployed person must check in advance what they can do, how to declare their vacation days and whether special authorization is necessary. In case of doubt, it is better to contact their payment organization or ONEM before leaving.
The risk is not theoretical. An undeclared or too-long stay abroad can result in loss of benefits for the period concerned, or even repayment requests if amounts were paid when conditions were no longer met.
For Moroccans in Belgium, the confusion often comes from the strong link with Morocco. Many consider vacations in the country as obvious, especially in summer or during family events. But for Belgian administration, a compensated unemployed person remains subject to strict obligations.
The rule to remember is simple: Belgian unemployment is not designed to finance a prolonged stay in Morocco. Leaving for a few weeks is possible within the limit of planned vacations. Staying away longer without exemption can jeopardize benefits.
