Belgium Tightens Family Reunification Laws: Income Thresholds Rise, Age Limits Increase

The Belgian House of Representatives approved, during the night from Thursday to Friday, the bill that makes the conditions for access to family reunification more stringent. The text, presented by the Minister of Asylum Anneleen Van Bossuyt, was supported by the majority of Belgian parties.

The bill aims to reduce the number of entries into Belgian territory through this channel, which is one of the main migration channels. The measures specifically target people benefiting from international protection, whose visa applications for this reason have increased from 9,358 in 2023 to 13,102 last year.

One of the main changes concerns the income requirement imposed on the sponsor. The reference amount is set at 110% of the guaranteed minimum monthly income, or 2,323 euros. This threshold will be increased by 10% for each additional family member. The Council of State had criticized this provision due to the absence of a ceiling. The minimum age for family reunification is also raised to 21 years.

In addition, the waiting periods are modified. The period allowing the family members of recognized refugees to join the country without condition is reduced to six months. For beneficiaries of subsidiary protection, this period is eliminated, a difference in treatment that has raised the concern of the Council of State. The general waiting period before a new arrival can initiate a family reunification procedure is also extended.
