Toulouse: Extradited from Morocco, he fights back

A man suspected of leading the drug trafficking network "Arai Farmers" appeared in Toulouse. His extradition from Morocco has become the center of a procedural battle, with the defense strongly contesting the legality of the arrest warrant.

Tried Tuesday by the Toulouse criminal court for the kidnapping of an individual named Adel between May 25 and 29, 2022, a 28-year-old man named Nicholas saw his trial monopolized by the conditions of his arrest. The defendant, presented as a leader of the criminal group "Arai Farmers," was extradited from Morocco on November 30, 2024.

His Paris lawyers, Masters Raphaël Chiche, Thomas Bidnic and Ravyn Issa, challenged the procedure that led to this transfer from Moroccan territory. The defendant had been convicted in absentia in May 2024. According to La Dépêche, the defense characterized this arrest warrant as illegal. Master Chiche argued before the court: "The conduct objectively did not allow us to consider that Nicholas was a fugitive. The warrant is unfounded."

This legal point generated multiple courtroom incidents with the judge, Didier Suc. The magistrate’s refusal to accept a request for forced appearance of two witnesses provoked the anger of the defense counsel. Master Bidnic vigorously denounced an "administrative conception of defense," accusing the public prosecutor of "undermining the European Convention on Human Rights."

The substance of the kidnapping case was only addressed at the end of the day. The defendant rejected any involvement in this matter, stating categorically: "I did not participate in this abduction!" He simply acknowledged having previously "played poker" with the victim. Finding the facts established, the prosecutor requested seven years in prison. The judgment will be delivered on May 28.
