Spanish Driver Acquitted in Fatal 2018 Pedestrian Accident in Sa Pobla

A court in Palma has acquitted a 52-year-old Spaniard who had fatally run over a Moroccan on a sidewalk in Sa Pobla in July 2018.
The facts date back to July 14, 2018 in Sa Pobla. As a Spaniard was driving his Ford Transit, he lost control around 5:15 pm and mounted a sidewalk. His van hit a pedestrian, who had been thrown to the ground, then crushed and dragged for about 13 meters, reports Majorca Daily Bulletin. The young Moroccan succumbed to serious head trauma 45 minutes later. The driver’s insurance company has in the meantime compensated his parents.
The Spanish driver appeared before a court in Palma. In the dock, he recounts the facts. He says he saw a man on the sidewalk who had then crossed the road and that he had tried to avoid him by turning onto the sidewalk. In the process, the pedestrian came back onto the sidewalk and he fatally ran him over. While he admits to having taken cocaine the day before, he claims not to have been under the influence of drugs at the time of the accident.
According to the explanations of a Guardia Civil officer, drowsiness is the cause of the accident, the driver not driving at high speed. This rules out any serious negligence on the part of the defendant or a serious fault. Based on the police officer’s testimony, the court acquitted the 52-year-old man, thus excluding the positive cocaine test.
