Morocco's Top Judge Warns Courts of Polygamy Authorization Abuse

The First President of the Court of Cassation and Delegate President of the Higher Council of the Judiciary (CSPJ), Mohamed Abdennabaoui, warned the presidents of the courts against the fraudulent use of the authorization of polygamy.

In a note addressed to the presidents of the courts, Abdennabaoui drew the attention of the latter to the repeated use, by certain unscrupulous husbands, of the same authorization to contract other marriages. "This practice empties the law texts aimed at protecting the family of their substance and infringes on the rights of women recorded in the polygamy procedure," specifies the Delegate President of the CSPJ in his letter reported by Al Ahdath Al Maghribia.

Abdennabaoui also reminded the presidents of the courts that "the authorization of polygamy is issued in the form of a court decision which concerns a particular and well-defined case, and must in no way exceed the framework for which it was issued. This is why the judge must be clear in his writing and precise in his pronouncement in order to avoid the multiplication of interpretations, both in its use and at the time of its execution."

This is why the President of the CSPJ has asked all the presidents of the courts to mention in the authorization of polygamy the first and last name of the new wife as well as all personal information concerning her in order to avoid the use of this document in other marriages. He also urges them to "inform the CSPJ of the obstacles they encounter in order to guarantee the good practice of the polygamy procedure [...], to protect the rights and dignity of the wives on the one hand, and to guarantee the cohesion and stability of the family on the other hand".
