Morocco Tightens Land Title Access to Combat Real Estate Fraud

The fight against the dispossession of real estate from Moroccans and foreigners is intensifying. From now on, users seeking to consult real estate will have to submit a written request and a court order, in accordance with the decree of 04/07/2014 on land registry procedures.
The Director General has issued a new circular aimed at avoiding the invocation of the legal liability of the registrars, in case of failure to comply with the procedures in force. Registrars are called upon to ensure strict control of requests for consultation of land titles.
However, any request for an inventory from a public administration, a judicial authority or the owner of the land title does not require a written request and a court order. It would be sufficient to present a copy of the national identity card or any other document proving the identity of the applicant and the person whose real estate is to be inventoried, reports Al Massae.
According to the Director General, the registrars will have to fill out and sign the information sheet attached to the aforementioned circular once the conditions are met. This sheet must then be sent to the central administration via an email duly accompanied by a copy of the necessary documents and the receipt of payment of the land registry fees.
