Morocco Speed Cameras: Court Ruling Ends Motorists’ Hopes

The ruling overturned a previous judgment by the Ouarzazate Court, which had acquitted a motorist on the grounds that the officer had not personally witnessed the speeding violation. The country’s highest court thus recognizes the autonomy of technical devices within the framework of the Highway Code.

Relying on Article 197 of the road legislation, the Court clarified that the electronic recording alone is sufficient to establish the offense. According to the judges, “the technical finding made by automated devices is sufficient to prove the violation,” even if the speed camera is concealed.

The legality of the proceedings is also unaffected by new transmission methods, such as sending images via messaging applications. This decision confirms the use of technology to monitor traffic and record violations.

From now on, the absence of an officer at the scene when the flash is triggered can no longer be invoked to seek the annulment of a report. Evidence from an approved device is now considered an incontestable legal basis before the courts.
