Morocco Rejects EU Court Ruling on Agricultural and Fisheries Agreements

The Court of Justice of the European Union (CJEU) handed down a decision on Friday concerning the agricultural and fisheries agreements between the EU and Morocco. Rabat strongly contests this decision, considering it inapplicable and tainted with errors.

Morocco claims not to be concerned by this decision, having not participated in any stage of the judicial procedure. "Morocco is not a party to this case, which concerns the European Union on the one hand, and the "polisario" supported by Algeria on the other," says an official statement.

Rabat denounces "suspicious factual errors" and "obvious legal errors" which would, according to the Kingdom, "testify to a total ignorance of the realities of the file, if not to a blatant political bias." The Court is even accused of "substituting itself for the competent UN bodies" and "contradicting their positions." By way of comparison, Morocco highlights the position of the British High Court which, in a similar case, would have shown "more discernment, impartiality and legal expertise."

Faced with this situation, Morocco demands that the EU and its Member States "take the necessary measures to respect their international commitments, preserve the achievements of the partnership and provide the Kingdom with the legal certainty to which it is legitimately entitled." The Kingdom recalls its role as an "EU partner on several strategic issues" and reaffirms its determination not to sign any agreement that would not respect "its territorial integrity and national unity."
