Morocco Real Estate Reform Paralyzes Property Sales and Transactions
The entry into force in early June of the register of powers of attorney linked to real rights is causing shockwaves. Administrative delays and procedural complexities are currently paralyzing real estate and financial transactions across Morocco.
On the ground, buyers find themselves blocked. Citizens wishing to purchase a home are suffering the full impact of the delay in mortgage release procedures. This administrative slowdown directly affects sales by power of attorney as well as the granting of bank credits, including participatory financing of the Mourabaha type. Confusion is worsening in certain courts that unexpectedly require additional documents, causing the accumulation of requests and the postponement of official contract signings.

This measure stems from law 31.18 aimed at standardizing practices and protecting assets against forgeries. While the stated objective is to strengthen contractual security, real estate law specialists are warning of a risk of instability. According to these experts, this excessive procedural rigor threatens confidence in business dealings. They emphasize the urgency of protecting good faith contracts without risking cancellation due to simple administrative failures beyond the control of buyers.
Faced with this paralysis, Bank Al-Maghrib is attempting to unblock the situation. The central bank indicates it anticipated the deadline by urging credit institutions to prepare quickly, according to Al3omk. Consultations were conducted jointly with the banking sector and the Ministry of Justice to define the practical aspects of this centralized register. These exchanges resulted in the development of an explanatory guide and the creation of a dedicated coordination unit.

The judicial authorities now assure that the digital platform of the register is operational, providing all notaries with accounts to register deeds. To overcome persistent blockages, the banking supervision directorate is closely monitoring operations. Emergency meetings are moreover scheduled for next week between financial actors and the Ministry of Justice in order to definitively remove obstacles hindering procedures.
