Morocco Prosecutes Over 3,000 for Adultery and Homosexuality, Report Reveals

Based on the Annual Report on Criminal Policy of the Attorney General, the Spanish news agency, EFE, indicates that 3,048 people were prosecuted for "adultery offense" in Morocco in 2018. In addition, 170 people had to deal with justice, for homosexuality and 73 others for abortion.

For the Spanish agency, EFE, these are all practices "sanctioned by Moroccan law", as part of "crimes against the order of the family and public morals". Recalling that adultery is punished by Article 491 of the Penal Code, HuffPost, citing the EFE, states that, in this case, "the guilty spouse can be sentenced to imprisonment (up to two years), [only if] the spouse who considers himself aggrieved complains; if the latter withdraws the complaint, the case is dismissed".

In the case of homosexuality, it is governed by Article 489 of the Penal Code. Prosecutions can result in 6 months to three years in prison, for "unnatural acts with individuals of the same sex", according to the EFE. In addition, it indicates that in 2018, 147 cases were opened, involving 170 people, prosecuted by the justice system.

Even if, with regard to abortion, the draft law has not yet been voted, it remains a practice punished "regardless of the circumstances", recalls the same source. The same Report also mentioned the number of people prosecuted for this reprehensible act. It also looked at cases of child marriage and notes that 36% of requests for marriage of minors were rejected in 2018.
