Morocco Proposes Strict Smoking Ban with Hefty Fines, Sparking Cafe Owner Backlash

Barely initiated, the bill aimed at banning smoking and vaping in public spaces is already facing opposition. Several cafe owners criticize the text. They point out that more than 70% of their customers are smokers, and that they prefer the cafe as a space to escape the constraints of work or home, in order to smoke in a relaxed atmosphere.

According to the text, the Islamist party proposes gradual financial sanctions. Any smoker in a prohibited place is liable to a fine ranging from 500 to 1,000 dirhams, which can rise up to 5,000 dirhams in case of recidivism. Fines are also planned for tobacco advertising or promotion. These fines can reach 10,000 dirhams in case of repeated violation.

According to some cafe owners, the potential adoption of this bill would lead to a decrease in attendance, or even widespread bankruptcy. They observed that cafes are subject to a series of taxes, licenses, and charges, while informal establishments offer similar services without any oversight. The law would be applied unfairly if it does not take this reality into account, they believe.

In the eyes of these professionals, it is necessary to find intermediate solutions, such as creating spaces reserved for smokers, following some successful international experiences, instead of a total ban that could drive customers away and push them towards unmonitored spaces.

On their side, many Moroccans welcome the PJD’s initiative. For them, smoking in enclosed spaces like cafes constitutes a real nuisance for non-smokers, especially those suffering from respiratory diseases or allergies to smoke. They therefore call for accelerating the implementation of the law in order to preserve everyone’s health and create healthier and cleaner public spaces.
