Morocco Passes Laws to Streamline Legal Processes for Expatriates

During its last plenary session, the House of Councillors unanimously adopted a bill and three draft laws, including one affecting Moroccans living abroad.

The House of Councillors has legislated in favor of Moroccans residing abroad (MREs). In total, one bill and three draft laws were adopted. First, the bill concerned supplemented Article 430 of the Code of Civil Procedure and aims to allow the courts to hand down judgments, in a short time, for the benefit of the Moroccan community established abroad, in particular, during the summer period. This will be followed by the adoption of draft law No. 31.18 amending and supplementing the dahir of 9 Ramadan 1331 (August 12, 1913) forming the Code of Obligations and Contracts. Indeed, this text is part of the implementation of the royal instructions contained in the Royal Letter addressed to the Minister of Justice on December 30, 2016. It was requested from this authority to put in place an urgent action plan to counter the phenomenon of the spoliation of the real estate property of others.

Furthermore, the organic law project No. 17.19, amending and supplementing organic law No. 02.12 relating to the appointment to senior positions, in application of the provisions of Articles 49 and 92 of the Constitution, was also adopted.

The objective of this project is to amend and supplement the regulations of public establishments and enterprises and the senior positions stipulated in Annexes 1 and 2 of Organic Law No. 02.12.

In addition, the House of Councillors adopted the articles amending the draft law relating to its Internal Regulations, to adapt them to the decisions of the Constitutional Court.
