Morocco to Overhaul Outdated Traffic Accident Compensation Law

The Minister of Justice, Abdelatif Ouahbi, announced an upcoming revision of the dahir governing the compensation of victims of traffic accidents, a text that is nearly 40 years old. This announcement follows a meeting held with various stakeholders in the sector, including insurance companies.
The main objective of this reform is to modernize a system considered obsolete and unsuitable for current economic realities. The minister notably pointed to the derisory amount of compensation, set at 9,270 dirhams per year, a sum well below the current minimum wage.
In addition, the current law is criticized for its discriminatory nature, basing compensation on the income of the victims. Experts also denounce a systematic underestimation of moral damages.
Abdelatif Ouahbi took the opportunity to settle scores with the former director of the Traffic Accident Guarantee Fund, accusing him of blocking the payment of compensation and not respecting court decisions. The minister revealed that thousands of files have been awaiting processing since 2015.
This revision of the dahir, promised by the government, aims to do justice to victims of traffic accidents and put an end to years of injustice and dysfunction.
