Morocco Implements New Regulations for Airbnb and Tourist Accommodations

Published in the latest issue of the Official Journal, Decree No. 2.23.441 relating to the determination of certain provisions of Law No. 80.14 concerning tourist establishments and other forms of tourist accommodation has entered into force, reports the website al3omk.com. This decree aims to regulate the various forms of tourist accommodation, including tourist real estate developments, home stays, bivouacs, alternative accommodations such as Airbnb, as well as tourist restaurants.

The text specifies the administrative procedures related to the opening and operation of tourist establishments, in accordance with the principles of strengthening the specialization of administrations and their responsibilities, as well as the guidelines of advanced decentralization and the overhaul of the authorization and classification process. It also sets the deadlines for processing files. Similarly, the decree provides for provisions determining the administrative procedures relating to tourist establishments and their operation, establishing the operating license before the opening of any tourist accommodation establishment to the public, by putting in place a new methodology for the classification of operation allowing to regulate the quality of the services provided, it is specified.

The modalities of supervision, the modalities of renewal of the operating classification of tourist accommodation establishments and the issuance of the operating license for allocated real estate developments and the classification of tourist restaurants, after the opinion of the unified regional investment commission, as well as the modalities of issuing operating licenses for other forms of tourist accommodation, namely the motorhome (Bivouac), home stay and alternative accommodation, which are authorized by the local authorities, after consultation with the services concerned and in compliance with their specifications, have been defined by the same decree.
