Morocco Court Blocks Elevator Parking Lockouts for Unpaid Fees
A Moroccan court has just ruled: a property manager cannot deprive a resident of access to parking or elevator in case of payment arrears. A decision that puts an end to these punitive practices.
Delays in payment of monthly contributions do not justify any individual sanctions. The court of first instance in Nador condemned a representative of co-owners to immediately return an elevator card and a garage key to a resident, under penalty of a daily fine of 200 dirhams for each day of delay. This interim order, issued on April 21, 2026, includes provisional execution and places court costs on the defendant. The judge ruled that financial disputes give building managers no power to use blackmail.

The case erupted when a property owner urgently sought legal action, noting the daily impossibility of reaching his floor by elevator and the obligation to park his vehicle on the street. To justify these blockages, the syndic cited disagreements related to the residence’s financial obligations. To support its decision, the court referred to law 18.00 on co-ownership. The tribunal ruled that the normal use of a private apartment remains intimately linked to these common facilities, placed under strict legal protection. The judgment specifies that this access prohibition characterizes continuous harm requiring the intervention of the judge of interim measures, whose mission is to "remove the damage and restore the situation to its original state," without ruling on the underlying financial conflict.
