Morocco: She wants a birth certificate, the State tells her that it ignores... her sex

A routine administrative procedure has turned into a legal headache for a resident of Rabat. When she came to pick up a birth certificate at the Hassan district office, she was met with an unexpected refusal: the administration does not know her sex and now requires a court decision to settle the matter.

The young woman presented herself at the counters to obtain a copy of her civil status document, but the procedure immediately got stuck. The officials told her that they were unable to issue the requested certificate, as the registers did not specify whether she was male or female.

Faced with this administrative void, a complex process has been imposed on the applicant. She was first invited to go to the Ibn Sina (Souissi) hospital, her place of birth, to retrieve the original certificate, the reference document supposed to contain the initial data.

Legal action necessary to regularize the situation

Retrieving the hospital archive is not enough, however. The district employees informed the young woman that she had to urgently file a lawsuit with the competent court to initiate legal action. The goal is to obtain a judgment officially determining her sex. It is only once this court decision has been rendered and transmitted to the services of the Hassan district that she will finally be able to receive a copy of her birth certificate.
