Moroccan Women’s Rights Group Pushes for Equitable Asset Division in Divorce Law

An association is proposing the modification of certain articles of the Family Code to correct the injustice done to Moroccan women in cases of marital conflicts. They are often excluded or do not benefit from the fair sharing of assets acquired during the marriage.
To better support and help women to have a share of the assets acquired during the marriage in the event of a problem, an association has filed a request with the main idea: "what we have acquired together, let’s share it equitably", wishing thus the modification of articles 49, 51 and 322 of law 7-03 on the Family Code. This project differs from that of the reform of the Moudawana, specified Asmaa Moudden, representative of the commission in charge of the request, reports Lavieeco.
The idea of this request concerning the sharing of the couple’s assets in the event of a conflict, divorce or death, comes from the conclusions drawn from a field survey conducted by the association. According to the survey, the participation of the woman and her domestic work are not taken into account when a separation occurs, or rather, it is a "broad ignorance" of Article 49 of the Moudawana. Since the adoption of the Family Code in 2004, 17 years later, only 0.5% of unions have been followed by a contract governing the management and sharing of the couple’s assets, according to statistics from the Ministry of Justice. Hence the request filed to correct this problem.
But since the modification of this single article will be insufficient to achieve the goal, the project also concerns the reform of articles 51 and 322 of the Family Code. Thus, after the filing of the request, a petition will be launched to collect 25,000 signatures for this cause. In addition, two Facebook pages have been set up to "explain, popularize and inform about the need for this reform," added Asmaa Moudden, specifying that a campaign will be launched just after the elections scheduled for next September.
